FOREIGNER APPROVED IN PUBLIC COMPETITIVE EXAMINATION TO BE A TEACHER AT THE UNIVERSITY DOES NOT NEED TO HAVE A PERMANENT VISA

 

A Peruvian citizen, with a temporary visa, was approved in a public contest to be a teacher at the Federal University of Tocantins, but was prevented to start his activities due to the absence of a permanent visa.


However, according to the Law 6.815/80, which defines the legal status of foreigners in Brazil, it is admitted the conversion of a temporary visa into a permanent one in case of teachers or high-level researchers and scientists to whom was permitted to exercise public or private activities, in the educational, scientific and technological research fields.


The Federal Judge responsible for the case considered illegitimate the requirement of a permanent visa and allowed the teacher to be admitted to the board of the University.
